These Terms of Service ("Terms") govern your access to and use of the ThreatScout platform and services ("Services"). Please read these Terms carefully. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.
ThreatScout is a unified threat hunting and security operations platform that enables security teams to detect, investigate, and respond to cyber threats. The platform integrates with various security tools, provides cross-platform querying capabilities, and offers case management and automated playbooks for security operations.
ThreatScout is offered as a cloud-based software-as-a-service (SaaS) platform, with each customer provisioned their own isolated infrastructure environment for enhanced security and performance.
Access to the Services requires a formal agreement between ThreatScout and your organization. ThreatScout accounts are provisioned only to authorized users within approved enterprise customers.
You acknowledge that ThreatScout is designed exclusively for enterprise use by businesses and organizations. The platform is not available for general public sign-up or personal consumer use. By accessing the Services, you represent and warrant that you are an authorized user within an organization that has executed a formal service agreement with ThreatScout.
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify ThreatScout immediately of any unauthorized use of your account or any other breach of security. ThreatScout will not be liable for any loss or damage arising from your failure to comply with this section.
ThreatScout may require you to change your password if we believe your account is at risk, or if we implement new security measures.
You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to use the Services:
You may only use ThreatScout to conduct security operations, threat hunting, and incident response activities within your own organization's environment or on systems and networks for which you have explicit permission to conduct such activities. You are solely responsible for ensuring all security testing and monitoring activities conducted through ThreatScout comply with applicable laws and regulations.
Access to the Services may require payment of fees. ThreatScout offers different subscription plans, with pricing and features as described on our website or in a separate agreement.
Unless otherwise agreed upon in writing:
Failure to pay fees may result in suspension or termination of your access to the Services. Reinstatement may be subject to payment of all past due fees plus additional reconnection fees.
These Terms will continue to apply until terminated by either you or ThreatScout as follows:
Termination by You: You may terminate these Terms by canceling your account and discontinuing use of the Services. You can cancel your account by contacting ThreatScout support.
Termination by ThreatScout: ThreatScout may terminate these Terms at any time for any reason, including if:
Effect of Termination: Upon termination:
ThreatScout will provide a mechanism for you to export your data prior to account deletion, subject to any limitations in your subscription plan.
ThreatScout is committed to implementing and maintaining appropriate technical, organizational, and physical safeguards to protect your data. Our privacy practices are described in our Privacy Policy, which is incorporated by reference into these Terms.
ThreatScout provides each enterprise customer with dedicated AWS infrastructure to ensure data isolation. We do not access customer security data or tenant environments except in specific technical support scenarios with explicit customer permission. This architecture ensures your security data remains isolated and protected from other customers.
You retain all rights, title, and interest in and to your data. You grant ThreatScout a limited license to host, use, process, display, and transmit your data solely to provide the Services to you and as otherwise permitted by these Terms and our Privacy Policy.
ThreatScout strives to maintain high availability of the Services. Specific service level commitments, including availability targets, support response times, and remedies for failure to meet these commitments, are provided in our Service Level Agreement (SLA), which may vary based on your subscription plan.
ThreatScout may schedule maintenance windows during which the Services may be unavailable. We will provide advance notice of scheduled maintenance whenever possible.
The Services, including all content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by ThreatScout or its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
These Terms do not grant you any rights to use ThreatScout's trademarks, logos, domain names, or other brand features. You may not remove, alter, or obscure any copyright, trademark, service mark, or other proprietary rights notices incorporated in or accompanying the Services.
Any feedback, comments, or suggestions you provide regarding the Services is entirely voluntary, and ThreatScout will be free to use such feedback, comments, or suggestions without any obligation to you.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THREATSCOUT DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
THREATSCOUT DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE SERVICES IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE. YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION OF PROBLEMS CAUSED BY VIRUSES OR OTHER HARMFUL COMPONENTS.
THREATSCOUT MAKES NO WARRANTIES OR REPRESENTATIONS THAT THE SERVICES WILL DETECT ALL SECURITY THREATS OR VULNERABILITIES. YOU ACKNOWLEDGE THAT NO SECURITY SYSTEM IS FOOLPROOF AND THAT THE SERVICES ARE A TOOL TO BE USED AS PART OF A COMPREHENSIVE SECURITY STRATEGY.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THREATSCOUT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
IN NO EVENT SHALL THREATSCOUT'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE AMOUNT PAID BY YOU TO THREATSCOUT FOR THE SERVICES DURING THE TWELVE (12) MONTH PERIOD PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.
You agree to defend, indemnify, and hold harmless ThreatScout, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services, including, but not limited to, your User Contributions, any use of the Services' content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Services.
These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the state of Delaware, without giving effect to any choice or conflict of law provision or rule.
Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the federal courts of the United States or the courts of the state of Delaware, although ThreatScout retains the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country.
In the event of any dispute, you agree to first contact ThreatScout and attempt to resolve the dispute with us informally. If ThreatScout has not been able to resolve the dispute with you informally, we each agree to resolve any claim, dispute, or controversy by binding arbitration, rather than in court.
The Services may be subject to U.S. export control laws and regulations. You agree to comply with all such laws and regulations, and you represent and warrant that you are not located in a country that is subject to a U.S. government embargo, or that has been designated by the U.S. government as a "terrorist supporting" country, and that you are not listed on any U.S. government list of prohibited or restricted parties.
ThreatScout reserves the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services.
Entire Agreement: These Terms constitute the entire agreement between you and ThreatScout regarding your use of the Services and supersede all prior and contemporaneous written or oral agreements between you and ThreatScout.
Waiver and Severability: The failure of ThreatScout to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
Assignment: You may not assign or transfer these Terms, by operation of law or otherwise, without ThreatScout's prior written consent. Any attempt by you to assign or transfer these Terms, without such consent, will be null. ThreatScout may freely assign or transfer these Terms without restriction.
Notices: Any notices or other communications provided by ThreatScout under these Terms will be given by posting to the Services or by email to the address you provide during registration.
